The Higher-Risk Buildings (Descriptions and Supplementary Provisions) Regulations 2023 (the Regulations) are Regulations which build on the provisions in the Act to complete the legal definition of higher-risk building. Higher-risk building is the technical term for buildings within the scope of the higher-risk regime. This guidance is designed to help users understand whether a building meets the criteria to be considered a higher-risk building. A residential unit can be found within any type of building and could have any tenure. Privately owned, private rented and social rented units are all considered residential units under the higher-risk regime.
