If BA seriously wants to treat a passenger they have abused in this way like this, then people are going to take proactive action as they do in America, and every passenger that has as little as a broken fingernail will make sure to declare themselves as disabled, to the airline when booking.

You should have been entitled to a duty of care and should have been fully informed of your rights. I guess BA will state that you were informed as they eventually rerouted you via JNB however per Article 4 BA should have called for volunteers first before denying you boarding. I would ask for evidence that this happened. However as the statute does not state a limit date however is clearly written generally in favour of the passenger’s right to choose, so far as the UK is concerned that does open a gap that leaves open for a general UK legal principle of reasonableness to be questioned – ie justified for the passenger’s own circumstances, why a longer date would be reasonable. I still think however that BA in downgrading is effectively denying boarding for the seat in the cabin you booked. They realise that they can avoid compensation by involuntarily downgrading instead – they could upgrade but that hardly ever happens especially if you don’t have status.

It’s a shame passenger does, apparently, not have the right to refuse a downgrade and have it automatically qualify as a cancellation. I don’t know if this will be your new normal going forward but it is obviously important at the moment while you are still recovering from your surgery. Sometimes you really have to advocate for yourself and `it sounds as if you can’t really afford to run the risk of BA trying to downgrade you again. As Lady London says, you do not need to provide proof from your doctor, although it probably wouldn’t hurt to carry it.One thing I do not want to do is to just take a bunch of flights strictly for the purpose of getting TPs; I'd like to go somewhere (or some places) fun and interesting, preferably somewhere or places I've never been. If the timing is right, some places near the ocean with nice weather would be a plus . . . . . Given BA's tendency to cancel flights during shoulder seasons, it would be better to plan something that has more than "thin" service where I could end up with 4 flights or no flights a week if the BA gods so decree. So might not be so useful for you I’m not sure i understand your last two points? Düsseldorf cancelled the flightplan as we were delayed leaving LHR. If we had left on time, or no more than an hour late then we would have made the flight before the curfew, therefore BA caused the delay and ultimate cancellation I offered to swap so she could have the direct flight (I was willing to go via Tokyo!) but computer said no as the agent couldn’t transfer my flight to her – it would have been released into the wild to get taken by whoever was on the waitlist.

It’s been a while and I thought people might be interested in what happened. This is still unresolved. BA ignored my (registered delivery) letters for 3 months and so the case is now with CEDR. They do however accept that (i) the only available seats on the flight I’d booked were in economy (so a 2 class downgrade) and (ii) I had phoned them several days prior to departure to confirm that we had business class seats, and they had confirmed this was the case. The aerodynamic engine testing is part of the broader Flying Technology Demonstrator programme that was first announced by the UK Government in July 2022. This programme aims to deliver the Tempest, a supersonic stealth combat aircraft set to take flight within the next four years. The development involves experts from BAE Systems, Rolls-Royce, Leonardo UK, MBDA, and the Ministry of Defence (MOD), in collaboration with various British small and medium-sized enterprises.
